LUVLYFANS CREATOR AGREEMENT

This Creator Agreement ("Agreement") is entered into by and between you ("Creator," "you," or "your") and TA Solutions LTD, trading as LuvlyFans, a limited company registered in England and Wales with company number 15144767, located at 9 Cheviot Crescent, Whitehouse Milton Keynes MK8 1ER ("LuvlyFans," "we," "our," or "us"). This Agreement governs your use of the LuvlyFans platform as a content creator.

1. Eligibility and Acceptance

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and capable of entering into legally binding contracts to register as a Creator. By using LuvlyFans as a Creator, you agree to this Agreement and our Terms of Service.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must keep your account information accurate and up to date.

3. Independent Contractor Status

You acknowledge that you are an independent contractor and not an employee, agent, or partner of LuvlyFans. You are solely responsible for determining your activities, pricing, working hours, and content creation.

4. Creator Earnings

4.1 Revenue Share
You will receive a percentage of the revenue generated from your content as defined on the platform or in your Creator dashboard. LuvlyFans retains the remaining percentage as a platform fee.

4.2 Payouts
Payouts are processed through supported payout providers (e.g., Paxum, crypto wallets). Minimum withdrawal thresholds and processing times apply.

4.3 Taxes
You are solely responsible for reporting and paying all applicable taxes and complying with any tax obligations in your jurisdiction. LuvlyFans may issue tax forms as required by law.

5. Content Ownership and Licensing

You retain ownership of all content you post. You grant LuvlyFans a worldwide, non-exclusive, royalty-free license to use, host, display, and distribute your content on and in connection with the platform and for marketing purposes.

5.1 Consent and Distribution Authorization
By posting content on LuvlyFans, you affirm and certify that:

  • You have obtained written consent from all individuals depicted in your content to:
    • Be depicted in the content;
    • Permit public display and distribution of the content on the LuvlyFans platform;
    • Allow viewing, streaming, and, if applicable, downloading by users.
  • You have verified that all individuals depicted are at least 18 years old (or the age of majority in their jurisdiction), and have obtained documented proof of age (e.g., valid government-issued photo ID).
  • You agree to retain all records of consent and age verification, and make them available upon request for compliance or legal purposes.

6. Acceptable Content

You may not post any content that violates:

  • Applicable laws or regulations
  • Section 6 of the LuvlyFans Terms of Service
  • Our Moderation and Prohibited Content Policies

All content must feature consenting adults. You must maintain documentation verifying age and consent and comply with 18 U.S.C. § 2257 where applicable. You further agree to store these documents and present them upon request for verification.

7. Moderation and Enforcement

LuvlyFans may monitor, moderate, or remove any content that violates this Agreement or platform policies. Repeated or serious violations may lead to account suspension or termination.

8. DMCA and Copyright Infringement

You must not upload content that infringes the intellectual property rights of others. We respond to DMCA takedown notices in accordance with our DMCA Policy.

9. Confidentiality

You must not disclose non-public information about LuvlyFans, including platform features under development, internal policies, or financial information.

10. Termination

We may terminate or suspend your Creator account if you breach this Agreement or applicable laws. You may terminate your account at any time. This Agreement shall remain in effect for as long as your Creator account is active. Upon termination, we may retain certain data as required by law or for dispute resolution.

11. Disputes

All disputes arising from this Agreement are subject to the arbitration and governing law clauses in the LuvlyFans Terms of Service.

12. Indemnification

You agree to indemnify and hold harmless LuvlyFans from any claims, damages, losses, or expenses arising from your content, actions, or breach of this Agreement.

13. Amendments

We may update this Creator Agreement at any time. Changes become effective when posted. Continued use of the platform after changes constitutes acceptance.

14. Entire Agreement

This Agreement, along with the LuvlyFans Terms of Service and Privacy Policy, constitutes the entire agreement between you and LuvlyFans regarding your Creator activities.
